a. “Cloud Software” refers to the software as a service (SaaS) provided by Emotiva.
b. “User” refers to any person or entity that accesses and uses Cloud Software.
c. “Client” refers to the person or entity that has purchased the Cloud Software service.
d. “Mobile Asset” refers to the means of transportation (vehicle, boat, train).

a. Cloud Software is intended for commercial use, subject to these terms and conditions.
b. It is not allowed to use Cloud Software for illegal or unauthorized purposes.
c. Users are responsible for maintaining the confidentiality of their login credentials and all activities carried out under their account.

The service offered by EMOTIVA, which includes cloud software and hardware. The cloud software is available 24 hours a day, but its provision depends on third-party platforms and factors such as coverage in the area and power supply of the mobile asset. EMOTIVA undertakes to mitigate any interruptions in the service and offers a minimum level of guaranteed service in case of critical failures. It is recommended to carry out preventive maintenance every three months to ensure the correct functioning of the hardware. Corrective maintenance must be requested by the client and is subject to specific fees. During these processes, the client may carry out procedures under the supervision of the personnel assigned by EMOTIVA.

a. Emotiva retains all intellectual property rights over Cloud Software and its content.
b. Reproduction, distribution, or modification of the software is not allowed without prior written authorization from Emotiva.

a. Emotiva respects users’ privacy and protects their personal data in accordance with our Privacy Policy.
b. By using Cloud Software, users accept the processing of their personal data as described in our Privacy Policy.

We will retain certain data that you transmit to the site in order to manage site performance, as well as data related to your usage. Although we perform routine periodic backups of the data, you are solely responsible for all data that you transmit or that is related to any activity you have undertaken using the site.

C. It is recommended that the User take appropriate measures and act diligently when accessing the cloud service, such as having protection programs, antivirus software, for handling malware, spyware, and similar tools.

There may be information on the site that contains typographical errors, inaccuracies, or omissions, including descriptions, prices, and any other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

a. Emotiva reserves the right to suspend or terminate a user’s access to the service in case of breach of these terms and conditions.
